Terms & Conditions
Reference document, drafted on the legal structure already used by SC Pozitron Grup SRL on other platforms it operates (including MuzicaTerapeutica.ro). A final legal review is recommended before commercial launch.
1. Definitions
- Platform — the SYNQ app, operated by SC Pozitron Grup SRL, available at synq.pozitron.ro.
- User — the person using the SYNQ app, with or without an account (patient, therapist or visitor).
- Service — generating adaptive audio sequences from a descriptive text of the emotional state, and the extended "SYNQ PRO" access, purchasable online.
2. Nature of the service — not a medical device
SYNQ is a wellness application. The displayed scores (anxiety, sync) and generated recommendations reflect an internal text-analysis algorithm, not a clinical evaluation, medical or psychological diagnosis. SYNQ does not replace treatment prescribed by a physician or psychotherapist. In a medical or psychiatric emergency, contact emergency services.
3. Acceptance of terms
By using the app and, respectively, by completing payment for SYNQ PRO, the User confirms they have read and fully accepted this document.
4. Description of the SYNQ PRO service
SYNQ PRO is paid access, valid for a fixed period (30 or 365 days from activation), offering unlimited sessions, extended history and additional features versus the free tier. PRO access does not auto-renew — the User activates it again, manually, whenever they wish to continue.
5. Delivery
The service is digital. PRO access is activated automatically on the account, immediately after NETOPIA confirms payment.
6. Right of withdrawal
As the services are digital and fully performed at the User's express request before the 14-day withdrawal period expires, the User expressly waives the right of withdrawal provided by Romanian consumer law, by completing the order and payment.
7. Refund policy
- In case of a payment error not attributable to the User (double charge, Platform technical error), the amount is refunded in full, within a maximum of 7 calendar days.
- For requests, write to synq@pozitron.ro, mentioning the order ID.
8. Therapist accounts
Registering as a therapist requires additional data (specialty, accreditation number) and is intended exclusively for mental-health professionals. SC Pozitron Grup SRL reserves the right to request further verification or to suspend accounts that do not meet this condition.
9. Use of statistical data for research purposes (applicable to therapists)
BY REGISTERING AS A THERAPIST AND BY USING THE FREE SYNQ PLATFORM, THE THERAPIST AGREES THAT SC POZITRON GRUP SRL MAY USE exclusively anonymized and aggregated data generated within the SYNQ platform for research and statistical analysis purposes, in compliance with Regulation (EU) 2016/679 (GDPR), Romanian Law No. 190/2018, and any other applicable legal provisions.
For this purpose, SC Pozitron Grup SRL shall not use any data that allows the direct or indirect identification of patients, including, without limitation, first and last name, home or residence address, phone number, email address, or any other identifier or combination of data that could lead to the identification of a natural person.
Data used for research purposes shall be limited to data that has been irreversibly anonymized or aggregated in such a way that the data subject can no longer be identified, in accordance with the data minimization principle and the safeguards set out in Article 89 of the GDPR. To the extent that any data cannot be considered anonymous, such data shall be processed only on the applicable legal basis and subject to appropriate technical and organizational measures.
10. Limitation of liability
SC Pozitron Grup SRL is not liable for decisions the User makes based on the app's generated recommendations, nor for temporary Platform unavailability due to force majeure.
11. Governing law
This document is governed by Romanian law. Disputes are settled amicably; failing that, Romanian courts have jurisdiction.
